If the tenant appeals to County Court, Texas law requires attorney representation. We provide referrals.
New Eviction Case
The eviction process begins when a landlord determines a tenant has violated the lease or that an unauthorized occupant has entered the property. For squatter cases, we assess SB1333 eligibility first — qualifying cases can bypass the full JP court process. For all other cases, the correct notice must be identified and prepared.
Important Notes
Texas Property Code § 24.011 permits authorized agents to represent landlords in JP eviction hearings. DFW Eviction Pros, LLC is not a law firm and does not provide legal advice. For legal counsel, consult a licensed Texas attorney.
The constable supervises the writ execution but does not move belongings, change locks, or provide any supplies. You are responsible for: (1) a moving crew or hired movers to move belongings to the property line, (2) a licensed locksmith to re-key all exterior locks, and (3) any necessary supplies such as trash bags, boxes, or PPE. The constable will not proceed without the crew and locksmith on-site.
Changing locks, removing belongings, or shutting off utilities without a valid court order is illegal under Texas law and exposes you to significant civil liability. Always follow the legal process.
Hearing schedules, constable availability, and court processing times vary across Dallas, Tarrant, Collin, and Denton counties. We know each precinct's requirements and work to move your case as efficiently as possible.
